FORDHAM UNIVERSITY TICKET TERMS AND CONDITIONS

These Ticket Terms and Conditions (this “Agreement”) govern the purchase, acceptance, possession, and use of tickets for Fordham University events. By purchasing, accepting, possessing, or using a ticket, you acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement contains provisions relating to assumption of risk, release and limitation of liability, indemnification, and forum selection in the State of New York. If you do not agree to this Agreement, do not purchase or use a ticket. 

This Agreement constitutes a binding contract between you and Fordham University. The purchase, acceptance, possession, or use of a Ticket constitutes your unconditional agreement to be bound by this Agreement in its entirety. Each Ticket is a revocable license that grants the Ticket Holder a limited right to attend the specified Fordham University event (“Event”), subject at all times to this Agreement, all applicable laws, and all Venue rules and policies. Fordham University (“Fordham” or the “University”) reserves the right to revoke this license and deny admission to, or remove from the Venue, any person whose conduct violates this Agreement, Venue policies, or applicable law, without refund or compensation. Every person age two (2) or older must possess a valid ticket for admission unless otherwise expressly stated by Fordham. 

For the purposes of this Agreement, the following terms shall have the meaning set forth below and apply throughout this Agreement: 

(a) “Event” means any athletic contest, game, competition, exhibition, or any activity hosted, sponsored, or operated by Fordham or any authorized agent of Fordham.

(b) “Ticket” means any paper, digital, mobile, or electronic credential, barcode, or admission pass issued by or on behalf of Fordham University. 

(c) “Ticket Holder,” “User,” or “You” means any individual who purchases, accepts, possesses, uses, or attempts to use a Ticket, or who attends an Event.

(d) “Venue” means any stadium, arena, field, gymnasium, or other facility or location at which an Event is held. 

(e) “Fordham,” “University,” “We,” or “Us” means Fordham University and its trustees, officers, employees, agents, contractors, volunteers, representatives, and affiliated entities. 

All ticket purchases governed by this Agreement are final at the time of sale unless otherwise expressly stated in writing by an authorized Director of Fordham University. Ticket prices may include service charges, processing fees, convenience fees, or other administrative charges, all of which are governed by this Agreement and are non-refundable except as required by applicable law. Applicable federal, state, or local taxes may be added to pricing considerations. Fordham reserves the right to correct pricing errors and to cancel any transaction affected by such errors. In the event of cancellation due to a pricing error, the sole remedy shall be a refund of the amount paid. 

2.2 Ticket Use, Resale, and Transfer Restrictions

Tickets may not be duplicated, altered, or counterfeited. Tickets that are lost, stolen, destroyed, or obtained through unauthorized means will not be honored under this Agreement. Fordham University cannot guarantee the authenticity or validity of tickets purchased through secondary markets, resale platforms, or other third-party sellers. Admission to an Event is guaranteed only for tickets purchased directly from Fordham University or through Fordham’s authorized, listed, and current ticketing partners. Tickets obtained through unauthorized sellers, resellers, brokers, or secondary marketplaces are used at the Ticket Holder’s own risk and may be denied entry, revoked, or invalidated at any time, including at the point of entry. The resale or transfer of tickets is subject to Fordham’s ticket resale policies and applicable law. Tickets may only be resold, transferred, or used for commercial purposes with Fordham’s written consent, except through platforms or methods expressly authorized by Fordham. Fordham reserves the right to invalidate any ticket that is resold, transferred, or maintained in violation of these Terms without a refund. Fordham retains the right to impose additional restrictions on transferability for certain events or tickets at its sole discretion. Patrons who exit the Venue may not be re-admitted until halftime of the Event, if at all, as determined by Venue policy and this Agreement. 

2.3 Exchanges, Refunds, and Cancellations

All ticket sales are final, nonrefundable, and unexchangeable, except as expressly provided herein or as required by applicable law. If an event is canceled and not rescheduled, Fordham will issue a refund of the ticket’s face value to the original purchaser, minus any applicable service fees that were charged during the initial transaction. If an event is postponed or rescheduled, the ticket shall remain valid for the new date. Fordham may, at its sole discretion, offer refunds or credits. If an event undergoes a material change (including, but not limited to, changes in date, time, venue, or featured participants), Fordham reserves the right to determine appropriate remedies, including offering refunds, credits, or exchanges, at its sole discretion. An exchange by the university may take the form of a ticket of equal or greater value for another Event, subject to availability. No refunds or exchanges will be provided for the reasons, including, but not limited to, weather conditions, scheduling changes, lineup or roster changes, or the purchaser’s inability to attend. All refunds, if issued, will be made only to the original purchaser using the original method of payment. In the event of any such changes, Fordham will make reasonable efforts to notify Ticket Holders of such changes and their available options. Fordham does not guarantee the participation of any specific player, team, or performer. Event details, including participants, rosters, and schedules, are subject to change at any time without notice. Such changes shall not entitle the ticket holder to any refund, credit, or exchange, except as determined by Fordham in its sole discretion. Ticket Holders are solely responsible for any travel or accommodation arrangements and assume all associated risks. 

Fordham is not responsible for technical issues, including but not limited to mobile device malfunctions, connectivity failures, software errors, or third-party platform outages that may affect ticket delivery, access, or scanning. e

As a condition of admission under this Agreement, all persons and belongings entering the Venue are subject to inspection, screening, and search at any time, with or without notice. By entering the Venue, you expressly consent to such searches and screening procedures. Refusal to submit to security screening or searches may result in denial of entry or removal from the Venue without refund. Fordham reserves the right to implement health-related screening protocols as deemed necessary, and failure to comply may result in removal from or refusal of entry to  the Venue without the option for a refund 

Outside food and beverages, including water, are prohibited inside the Venue under this Agreement. This prohibition includes food or beverages purchased elsewhere on campus. A limited exception may be made or documented medical needs, such as for individuals with diabetes or similar conditions, as determined by Venue staff. 

Bags are permitted inside the Venue only if they are small enough to fit under or within the Ticket Holder’s seat. Oversized bags may be denied entry unless the Ticket Holder has purchased a separate seat for the bag where permitted. Fordham reserves the right to restrict or prohibit bags at certain Events for any reason, including, but not limited to, security or space constraints. 

Firearms, knives, blades, pepper spray, flammable or combustible items, weapons of any kind, any other dangerous or hazardous items, and outside alcohol are strictly prohibited inside the Venue under this Agreement. This prohibition applies regardless of whether such items are lawfully owned or possessed outside the Venue. The only exception to this policy applies to authorized law enforcement personnel carry such items while acting within the scope of their official duties. Fordham University reserves the right, in its sole discretion, to determine whether any item poses a safety risk or otherwise violates this policy. Any violation of this section constitutes a material breach of this Agreement and may result in denial of entry, immediate removal from the Venue without refund, confiscation of prohibited items where permitted by law, and referral to law enforcement authorities. 

4. CONDUCT, MEDIA & COMMERCIAL ACTIVITIES

Fordham reserves the right to refuse admission or to eject any individual whose conduct is deemed, in Fordham’s sole discretion, to be disorderly, disruptive, unsafe, abusive, or in violation of applicable laws or venue policies. Prohibited conduct includes, but is not limited to: (i) intoxication or impairment, (ii) harassment or abusive behavior, (iii) unauthorized entry onto the field, court, or restricted areas, (iv) throwing objects or otherwise threatening another individual, and (v) failure to comply with venue or security personnel. No refunds will be issued in such cases. 

4.2 Photography, Video, and Audio Recording

Photography, video, or audio recording is permitted only for personal, non-commercial use. Any recording, transmission, or distribution intended for commercial purposes, public dissemination, or that substitutes for authorized broadcast coverage is prohibited without Fordham’s prior written consent. 

By attending an Event subject to this Agreement, you grant Fordham University and its designees the irrevocable right to photograph, film, record, and otherwise capture your image, likeness, voice, and appearance in connection with the Event and time spent on Fordham’s campus. You agree that such content may be used, without compensation, in any media now known or later developed for promotional, commercial, broadcast, or archival purposes. 

Fordham is not responsible for and does not guarantee the fulfillment of any third-party promotions, endorsements, or appearances involving student-athletes or other participants that are not directly operated by Fordham. Any name, image, or likeness (“NIL”) activities, sponsorships, or promotional engagements involving student-athletes are subject to change, cancellation, or modification without notice and do not constitute a guarantee of participation or appearance at any event. Ticket Holders acknowledge that purchasing a ticket does not guarantee the presence or participation of any particular individual and that no representation or expectation regarding specific athletes, performances, or appearances forms part of the ticket purchase. 

The sale or distribution of goods, services, or promotional materials at the Venue is prohibited unless expressly authorized in writing by Fordham. Unauthorized commercial activity may result in confiscation of materials and removal from the Venue. 

5. ASSUMPTION OF RISK, RELEASE & LIABILITY

Attendance at an Event involves inherent risks, including but not limited to personal injury, exposure to illness, loss or damage to personal property, and risks posed by other attendees. These risks may stem from, but are not limited to: (i) balls, equipment, and other objects leaving the field of play; (ii) player or participant contact; (iii) crowd-related incidents; and (iv) general conditions inherent to live sporting or entertainment events. By attending an Event governed by this Agreement, you knowingly and voluntarily assume all such risks. 

To the fullest extent permitted by law, you release and waive any and all claims against Fordham University and its affiliated parties arising out of or relating to attendance at an Event, including claims based on negligence. 

5.3 Limitation of Liability; Disclaimer of Warranties

To the maximum extent permitted by law, Fordham shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to this Agreement or an Event. Fordham makes no warranties, express or implied, except as expressly stated in this Agreement. 

Any parent, legal guardian, or other adult who purchases, accepts, possesses, or uses a Ticket on behalf of a minor, or who permits a minor to attend an Event, assumes full responsibility for the care, supervision, and conduct of the minor at all times, whether or not the parent or guardian is physically present with the minor at the Event. To the fullest extent permitted by law, the parent or legal guardian assumes all risks associated with the minor’s attendance and releases Fordham University from any and all claims arising out of or relating to the minor’s attendance, including claims based on negligence. This responsibility applies regardless of whether the minor possesses a Ticket, is admitted without charge, or is otherwise present at the Venue with or without supervision. The parent or guardian further agrees to defend, indemnify, and hold harmless Fordham University from any claims brought by or on behalf of the minor, except to the extent prohibited by applicable law. 

You agree to indemnify, defend, and hold harmless Fordham University, its trustees, officers, employees, agents, affiliates, sponsors, contractors, and event partners from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your attendance at the event, violation of these Terms, or misuse of a ticket. 

By purchasing or using a Ticket subject to this Agreement, you acknowledge that personal information is collected and processed in accordance with 

Fordham shall not be liable for any delay, cancellation, or modification of an event due to circumstances beyond its reasonable control, including but not limited to acts of God, weather conditions, natural disasters, public health emergencies, governmental actions, labor disputes, or travel restrictions. 

This Agreement shall be interpreted under the law of the State of New York, without regard to conflicts-of-laws principles. Any legal action, suit, or proceeding arising out of or relating to this Agreement shall be brought in a court of competent jurisdiction in the State and City of New York. You irrevocably submit to the jurisdiction of such courts and waive any objection based on venue or forum non conveniens. 

If you purchased a Ticket by telephone or mail and did not receive this Agreement at the time of purchase, you may request a refund within five (5) business days of receipt and prior to using the Ticket. Use of the Ticket constitutes acceptance of this Agreement. 

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect. Fordham’s failure to enforce any right under this Agreement shall not constitute a waiver. 

Fordham reserves the right to update or modify these Terms at any time. Any changes will apply to tickets purchased, obtained, downloaded, utilized, or otherwise accessed after such updates are posted.
